The legal treatment of physician-assisted suicide is in flux. Reform has been impelled by several forces, including the recent success of novel constitutional arguments in the Ninth and Second Circuit Courts of Appeals. I will review and discuss Compassion in Dying v. State of Washington and Quill v. Vacco, addressing the constitutional arguments, and then briefly considering the attractions and difficulties of these new constitutional theories.Before 1990, state criminal laws dealing with assisted suicide had reached a remarkably stable consensus: suicide (...) was not illegal, but assisting suicide was a criminal action with no distinction typically made between physicians and others who assisted. The details of the relevant criminal law varied from state to state. Some states had criminal statutes specifically addressing assisted suicide, while others treated the practice under more general homicide statutes. But in no state was it clearly legal for a physician to prescribe a lethal medication at the request of a dying patient. While remarkable legal developments took place during the 1970s and 1980s regarding other aspects of the rights of dying patients, there was relative quiescence regarding the law of PAS. (shrink)

This article explores the rhetoric, and mass mediation, of the national Holocaust Memorial Day commemoration ceremony, as broadcast on British television. I argue that the televised national ceremonies should be approached as an example of multi-genre epideictic rhetoric, working up meanings through a hybrid combination of genres, author/animators and modes. Epideictic rhetoric has often been depreciated as simply ceremonial ‘praise or blame’ speeches. However, given that the topics of praise/blame assume the existence of social norms, epideictic also acts to presuppose (...) and evoke common values, in general, and a collective recognition of shared social responsibilities, in particular. My methodology draws on the Discourse-Historical Approach to Critical Discourse Analysis, given, first, its central prominence in analysing argumentative strategies in discourse and, second, the ways it facilitates a reflexive ‘shuttling’ between text-discursive features, intertextual relations and wider contexts of society and history. Here, I examine how a catastrophic past is invoked in speech and evoked through image and music, in response to the demands that uncertainty of the future ‘places upon one’s conscience’. (shrink)

Referring to some perceived difficulties in social representation theory, this paper offers an account of the genesis of social representations in a theory of valuing. Drawing on influential but previously largely unconnected ideas from interactionist theory, personal construct theory, and Rokeach’s theory of values, it is suggested that a process of valuing can be presented as a crucial link between the individual and social levels of analysis, a present theoretical disjuncture that has been of concern to some commentators in social (...) representations and widespread beliefs. This book, first published in 1990, takes a critical look at the major assumptions which support critical thinking programs and discovers many unresolved questions which threaten their viability. John McPeck argues that some of these assumptions are incoherent or run counter to common sense, while others are unsupported by the available empirical evidence. This title will be of interest to students of the philosophy of education.

Let it be clear at the outset that in reappraising Dewey's thought we have to do with no minute philosopher. In breadth of interest and range of thought he belongs with the great comprehensive thinkers of the past. And in contrast to many thinkers both in his own time and since, he had a constructive program. Philosophy for him meant more than analysis, even though analysis is an important part of the philosophic enterprise. Dewey's constructive philosophy has too often been (...) lost in polemic discussion. I subscribe to the confession made some years ago by Ernest Hocking in which he said that he began to understand Dewey when he started reading him for enjoyment and not for the purpose of showing that he was all wrong! As Dewey's work shapes up in historical perspective, it assumes a great substantiality. One may disagree and one may correct, but in comparison with philosophy of a wholly technical and professional sort, Dewey's large-minded approach to genuinely philosophic questions places him among philosophers of stature. Utilitarians, maximinners, prioritarians, and sufficientarians each provide examples of situations demonstrating, often apparently compellingly, that a sensible ethical observer must adopt their view and reject the others. I argue, to the contrary, that an attractive ethic is eclectic or pluralistic, in the sense of coinciding with these apparently different views in different regions of the space of social states. This essay seeks to link management action with business ethics. It utilizes two conceptual models of decision making to examine the important processes of information gathering and information processing. This analysis is then related to the ethical aspects of a business decision to help explain differences in the selection of ethical criteria.

As interest in working memory is increasing at a rapid pace, an open discussion of the central issues involved is both useful and timely. This new volume compares and contrasts conceptions of working memory, with contributions from proponents of different views.

IN A PREVIOUS study entitled, "Time, Times and the 'Right Time': Chronos and Kairos," I explored the distinction between these two aspects of time and their relations to each other. I wish to return to the topic in this paper, building on my previous discussion but bringing in some new dimensions that were unknown to me earlier on. I did not know, for example, that kairos, although it has metaphysical, historical, ethical and esthetic applications, is a concept whose original home, (...) so to speak, was in the ancient rhetorical traditions. A recent study is aimed at recovering this important idea in the present situation. It is not insignificant that, while kairos has important philosophical implications, students of rhetoric have not been alone in neglecting it as can be seen from the fact that it is not listed in the four volume Dictionary of the History of Ideas, edited by Philip Wiener, nor is it to be found in The Great Ideas: A Syntopicon, edited by Mortimer Adler. One reason for the omission is no doubt the absence of any cognate word in English for kairos whereas its partner, chronos, appears in a host of forms throughout any English dictionary. The only exception that occurs to me is the quite rare word 'Kairotic' which is listed only in the most complete dictionaries. The loss of the concept of kairos is doubly unfortunate for, on the one hand, the idea has been of enormous significance in the past figuring essentially, for instance, in the religious traditions of the West, and, on the other hand, it expresses a most important feature of temporal process which, despite exceptions here and there, is not expressed in the concept of chronos. It is with these facts in mind that I am attempting to rehabilitate, as it were, the kairos aspect of time and to show its philosophical importance. (shrink)

If one is an egalitarian, what should one want to equalize? Opportunities or outcomes? Resources or welfare? These positions are usually conceived to be very different. I argue in this paper that the distinction is misconceived: the only coherent conception of resource equality implies welfare equality, in an appropriately abstract description of the problem. In this section, I motivate the program which the rest of the paper carries out.
